The Provo River Case is On in Utah

2chkfgt15xThe Utah Stream Access Coalition’s Provo / Right-to-Use Case was scheduled to open today before Judge Derek Pullan of Utah’s 4th District Court (125 N 100 W) in Provo. The trial is scheduled to run August 26-28 and September 2-3.

[We mean no disrespect by the image attached – after years of expert witness work in the courtroom, it’s just the mental picture that always pops to mind when I hear the term ‘courtroom battle’. Longtime readers understand that access issues are very near and dear to us and have been a core issue here at Chi Wulff for the past going on eight years now.]

For those that can attend, USAC has reminded everyone that –

USAC members are invited to attend the trial, and to show Judge Pullan their support for stream access. If you plan on attending, please dress appropriately and adhere to proper courtroom decorum: a crowd is best seen but not heard. This is not a rally, it is not the time for banners or signs, but for bodies en masse to silently support stream access.

The trial will focus on the fact that HB141, by effectively disposing of the public’s right to use more than 2,600 miles of ‘fishable’ and 470 miles of ‘floatable’ Utah rivers and streams, has substantially and negatively impacted the public’s ability to use and enjoy their remaining public waters. Most of USAC’s evidence demonstrating this reality will be presented the first three days of trial. We hope to see you there.
